Navigating Indemnity Clauses in Construction

When an accident or loss occurs, insurance adjustors and attorneys look at contractual relationship to determine the allocation of risk. While you may think you have a straightforward indemnification clause and standard additional insured status with an independent contractor, the additional insured endorsements have changed over time and more importantly can vary by contractor and insurance carrier.

A national electrical contractor, Eldeco is pleased to sponsor a Leadership Luncheon on indemnity and hold harmless clauses in Alabama construction contracts. On June 8 from 11 a.m. to 1 p.m. at the Associated Builders and Contractors office in Birmingham, Ala., attendees will learn:

• Indemnification related to insurance policies and liability
• How to document and minimize liability working with independent contractors

Presenters include Aman Kahlon, associate with Bradley Arant Boult Cummings LLP, and Gabe Clement, an account executive with the Byars | Wright Agency.

Kahlon represents owners, general contractors and subcontractors. He advises clients on delay, interference, defective design and negligence claims.

Clement is an experienced underwriter of construction projects. ABC Alabama Chapter named him a 2016 Future Leaders in Construction Graduate.
